Ahm, no.  Flicking you gum out the window *is* illegal.  There is no
variation in the "legalese" here.  What there is, however, is a
decision not to prosecute the crime being committed.

There's a huge difference in between how a law is interpreted and
whether or not it's enforced and upheld.  Looking the other way is not
"interpreting it differently".
