The difference however is that an ISP or phone company has fairly decent 
records of who's on their system and has contact information for the 
people on their system (with the exception of payphones of course).

True, an ISP is not liable if I do something criminal with my internet 
connection, but if given a court order they at least have the records to 
turn over to the authorities.
